Phantom Suing the Fox Theatre

ATLANTA (AP) - Joe Patten, the longtime resident of Atlanta's Fox Theatre who has been involved in a dispute over his right to remain there, is suing the organization that operates the building.

The 83-year-old Patten signed a lease with Atlanta Landmarks in 1979 allowing him to live in a renovated office space in the theater rent-free for the rest of his life.

The lawsuit comes after the Fox's board of trustees changed the terms in August, saying Patten could stay until he needs around-the-clock care. Patten had returned after treatment following a mild stroke.

Patten's attorney, Emmet Bondurant, filed the lawsuit Monday in Superior Court.

Fox officials say they believe the differences can be worked out.

Patten is credited with saving the theatre from the wrecking ball and saving it from fire in 1996.
